GENERAL TERMS AND CONDITIONS OF SALE

PRICES

Our prices are inclusive of all taxes, with bottles packed in cardboard boxes or wooden cases of 6 and 12 bottles, shipping included for all purchases of €100 or more.
For delivery in mainland France, shipping costs are €10 per package if the order amount is less than or equal to €100.
Deliveries are only made in mainland France, excluding Corsica.
All our offers are subject to stock availability.

 

DELIVERIES

– All the wines we offer are in stock, ensuring fast delivery under the best conditions.
– 95% of our deliveries are made within 5 days after receipt of the order.

All our wines are insured by us during transport and travel at our risk.

Delivery is made by the carrier to the address you provided at the time of order. In case of absence, the carrier leaves a delivery notice so that you can contact them to arrange a new delivery date.

You are required to check the condition of the goods upon delivery and report any damage, missing items, or errors on the delivery note, which you must send to us by registered mail with acknowledgment of receipt within 48 hours of receiving the goods.

We undertake to deliver within 30 days. However, our deliveries are usually made within about ten days. By phone, we can provide you with the approximate delivery date. This information is provided for guidance only and cannot be guaranteed. If delivery cannot be ensured within 30 days, you will be promptly informed and may cancel your order, request a product exchange, or a refund.

 

WINES EN PRIMEUR

Upon receipt of your order accompanied by its ex-tax payment, we will send you a paid pro forma invoice (ex-tax) serving as a certificate of ownership.
Once the wines are made available by the estate, we will send you the final invoice, which will show the current VAT amount (currently 20%), plus a shipping fee contribution of €10 (incl. tax) for delivery in continental France for orders less than or equal to €100.

 

PAYMENT

All wines are payable in Bordeaux.
In case of dispute, the Bordeaux Court has sole jurisdiction.

 

RIGHT OF WITHDRAWAL

You have a period of 14 working days from delivery to return, at our expense, any product that does not suit you, in good condition in its original packaging with the original invoice, for exchange or refund.

 

MONEY-BACK GUARANTEE

Château d’Arsac undertakes to refund you — after the wines are returned at its expense — for each bottle that you deem defective. This guarantee applies provided that you inform the estate of the dispute within 30 days of receiving the goods.

 

RETENTION OF TITLE

Until full and effective payment of the price, Château d’Arsac remains the owner of the goods sold. Full payment will constitute transfer of ownership. However, the buyer becomes responsible for the items upon delivery, the transfer of possession constituting a transfer of risk.

 

OUT-OF-STOCK VINTAGE

All our wines are delivered in the vintage indicated. They are available in limited quantities and served in the order of arrival of orders until stocks are potentially exhausted.

 

RIGHT OF ACCESS AND RECTIFICATION

In accordance with the provisions of the Data Protection Act of January 6, 1978, you have the right to access, rectify, and object to your personal data (CNIL No.: 27033).
To exercise this right, simply write to us, stating your first name, last name, and address.

 

PROTECTION OF MINORS

Pursuant to Ordinance No. 59-107 of January 7, 1959, and the law of July 1974, the sale of alcohol in France is prohibited to minors under 18 years of age.
Consequently, the buyer undertakes to be 18 years of age or older on the day the order is placed.

 

APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE / ENFORCEABILITY OF THE GENERAL TERMS AND CONDITIONS OF SALE

Placing an order implies the buyer’s full and unreserved adherence to these general terms and conditions of sale.
Any contrary condition set by the buyer will therefore, in the absence of our written acceptance, be unenforceable against us, regardless of when it may have been brought to our attention.
The fact that we do not, at any given time, avail ourselves of any of these present general terms and conditions of sale cannot be interpreted as a waiver of our right to avail ourselves of any of these said conditions at a later date.
